South African politician Julius Malema returned to court on Wednesday as prosecutors argued for the maximum 15-year prison sentence following his conviction for discharging a rifle at a public rally.
The leader of the Economic Freedom Fighters (EFF) was previously found guilty of unlawful firearm possession and firing a weapon in a public space during an incident in 2018.
While Malema has maintained that the device was merely a toy, the state is pushing for a severe penalty to deter others from similar behaviour.
The prosecution emphasised that as a member of parliament and a prominent public figure, Malema has a responsibility to uphold the law, particularly given his influence over young followers.
State attorneys argued that allowing the 45-year-old leader to avoid jail time would set a dangerous precedent.
Conversely, defence lawyers have appealed for leniency, suggesting a fine would be more appropriate since the act was a celebratory gesture intended to cause no harm.
The outcome of this sentencing carries significant political weight; any prison term exceeding 12 months would disqualify Malema from serving as a lawmaker once all appeals are exhausted.
This could pose a major challenge for the EFF, which currently holds the position of the fourth-largest party in parliament.
Following the court’s adjournment until Thursday, Malema addressed his supporters, asserting his intention to appeal any sentence handed down by the magistrate.
